Privacy policy for job applicants

We are delighted that you are interested in our company and that you are applying or have applied for a position with us. We would like to inform you below about the processing of your personal data regarding your application.

1. Who is the controller for data processing?

2. Which of your data are we processing? And for which purpose?
We process the data you provided to us as part of your application to assess your suitability for the job (or other open positions in our companies, if applicable) and to carry out the application process.

3. What is the legal basis for this?
The legal basis for the processing of your personal data in this application procedure is primarily § 26 of the German Federal Data Protection Act (BDSG). This allows the processing of data that is necessary in connection with the decision on the establishment of an employment relationship.

Should the data be required for legal prosecution after completion of the application process, data processing may follow based on the requirements of Art. 6 of the GDPR, in particular to safeguard legitimate interests in accordance with Art. 6 para. 1 lit. f of the GDPR. Our interest is then to assert or defend claims.

4. For how long will the data be stored?
Applicant data will be deleted after 6 months in case of rejection.

In case you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There the data is deleted after two years.

If you have been successful in the application process for a position, the data from the applicant data system will be transferred to our personnel information system.

5. To which recipients will the data be passed on?
We use a specialised software provider for the application process. This will act as a service provider for us and may also obtain knowledge of your personal data in the course of maintaining and servicing the systems. We have concluded an order processing agreement with this provider, which ensures that the data processing is performed in a permissible manner.

Upon receipt of your application, your applicant data will be screened by the HR department. Suitable applications will be forwarded internally to the department heads for the particular vacant position. We will then coordinate the further course of action. Within the company, only those persons have access to your data who need to do so for the proper conduct of our application process.

6. Where are your data processed?
The data is always processed on dedicated IT systems on our premises. Besides administrators, only members of the HR department and company management have access to these IT systems.

Should applicant data be processed by service providers, we ensure that this is done in compliance with data protection law. Applicant data is not processed outside the European Union.

7. Which rights do you have regarding the processing of your data?
You have the following rights in relation to Hänsch GmbH regarding personal data that concerns you:

Right of access
Right to rectification or erasure
Right to restriction of processing
Right to data portability
Right to revoke granted consents

7.1 Information on your right to object according to Art. 21 GDPR

Individual right to object
You have the right to object at any time, on grounds relating to your particular situation, against the processing of personal data relating to you performed based on Art. 6 para. 1 sentence 1 lit. e of the GDPR (data processing in the public interest) and Art. 6 para. 1 sentence 1 lit. f of the GDPR (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Art. 4 para. 4 of the GDPR.

If you object, Hänsch GmbH will no longer process your personal data. This is unless the latter can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms. Or if the processing serves the assertion, exercise or defence of legal claims.

Objection to the processing of your data for direct marketing purposes
On occasion, Hänsch GmbH will process your personal data for direct marketing purposes. You have the right to object to the processing of personal data concerning you for such marketing at any time; this also applies to profiling, insofar as it is associated with said direct marketing.

Should you object to processing for the purposes of direct advertising, Hänsch GmbH will no longer process your personal data for these purposes.
